Terms of Service

1. Acceptance of Terms

These Terms of Service (these "Terms") govern your access to and use of NP Tracker (the "Service," "we," "us," or "our"). By creating an account or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not access or use the Service.

2. Eligibility

You must be at least 13 years old to create an account or use the Service. By using the Service, you represent that you meet this requirement. If we become aware that an account belongs to someone who does not, we may suspend or terminate it.

3. Your Account

You must provide accurate information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account, whether or not you authorized it. Notify us immediately at support@nptracker.travel if you suspect your account has been compromised.

4. Your Content

You retain all ownership rights in the visit notes, photos, ratings, recorded hikes, and other material you submit to the Service ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to store, reproduce, and display Your Content solely as necessary to operate the Service and to make it available to whoever your visibility settings allow to see it. This license ends when that content is deleted, consistent with our Privacy Policy. If you choose to record a hike, that recording is the one exception to visibility: it is visible only to you regardless of your visibility settings. Nothing is recorded unless you start a recording.

You represent that you own Your Content or otherwise have the right to submit it, and that doing so does not violate any law or any third party's rights.

5. Prohibited Conduct

You agree not to:

Post content that is illegal, infringing, harassing, or that you don't have the right to post;
Post nudity, sexually explicit material, or any content that sexualizes a minor;
Access or attempt to access another user's account without authorization;
Interfere with or disrupt the Service, or attempt to circumvent its rate limits or security measures;
Scrape, bulk-extract, or systematically collect data from the Service beyond your own account's data export; or
Use the Service for any purpose that violates applicable law.

6. Reporting and Moderation

Report content or accounts that violate these Terms using the Report button. We investigate reports at our discretion and are not obligated to take any particular action on a given report. We may remove any content, including a profile photo, that violates these Terms, without notice, and doing so does not limit our right to suspend or terminate an account. We have zero tolerance for content that sexually exploits minors: any such content will be removed and the account terminated immediately, and reported to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law.

7. Third-Party Content and Attribution

Park descriptions, photos, operating hours, alerts, and similar content come from the National Park Service Data API. As works of the U.S. federal government, this content is generally in the public domain; some individual media may carry separate rights held by third parties. NP Tracker is an independent project and is not affiliated with, endorsed by, or sponsored by the National Park Service or the U.S. Department of the Interior. Icons throughout the site are provided by Font Awesome and licensed under CC BY 4.0. Weather forecasts come from the National Weather Service and, where NWS coverage is unavailable, from MET Norway (also CC BY 4.0). We do not control and are not responsible for the accuracy of third-party content.

8. Storage Limits

Cloud storage for photos you upload is capped per account. This doesn't apply to photos the Service references on your own device without uploading them. We'll tell you in the product if you're near or over the limit rather than silently rejecting uploads.

9. Termination

You may stop using the Service and delete your account at any time, as described in our Privacy Policy. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, harassed other users, or abused the Service. Sections 10 through 14 and this Section 9 survive termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We work to keep the Service reliable and your data intact, but we do not guarantee uninterrupted or error-free operation.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NP TRACKER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT, IF ANY, YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold NP Tracker harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of another.

13. Governing Law and Venue

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in the Commonwealth of Pennsylvania, and you consent to their jurisdiction.

14. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

15. Entire Agreement and Assignment

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service, and supersede any prior agreement on the same subject. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the product before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
